These Terms & Conditions (“Terms”) apply to work performed, products furnished, materials ordered, and services provided by KanView Glass, LLC (“KanView”).

They are incorporated into each KanView estimate, work order, change order, invoice, account agreement, electronic authorization, delivery, service call, and other approved scope (“Job Documents”), unless KanView expressly agrees to different written terms.

A job-specific written term controls only the particular subject it addresses. All remaining provisions of these Terms continue to apply.

1. DEFINITIONS AND ELECTRONIC COMMUNICATIONS

Customer means the person or entity requesting, approving, receiving, or financially responsible for the work and, where applicable, its authorized representative.

Job Documents include KanView estimates, work orders, invoices, approved change orders, account agreements, electronic approvals, written authorizations, and KanView addenda relating to the job.

Written or in writing includes paper documents, electronic signatures, email, text message, Housecall Pro or similar electronic communications, customer portals, and other documented electronic communications that reasonably identify the sender.

Workmanship defect means a condition caused by KanView's failure to properly perform the work within KanView's contracted scope. A product defect, pre-existing condition, building condition, customer use, ordinary wear, maintenance issue, or condition caused by another person is not a KanView workmanship defect merely because it becomes apparent after KanView performs work.

The Customer authorizes KanView to communicate through the phone number, email address, physical address, electronic platform, or other contact information supplied by the Customer.

The Customer is responsible for providing accurate contact information and notifying KanView of changes. A communication sent to the most recent contact information supplied to KanView may be relied upon as a reasonable contact attempt.

KanView may rely on documented electronic approvals and authorizations received from the Customer or a person reasonably represented to KanView as authorized to act for the Customer.

2. ESTIMATES, SCOPE, AND ACCEPTANCE

Unless stated otherwise, an estimate is valid for 30 days. Supplier cost, product availability, freight, fabrication requirements, tax, lead time, and scheduling may change after that period.

KanView is responsible only for the products and services specifically listed in the accepted scope. Painting, staining, refinishing, carpentry, framing, drywall, electrical work, plumbing, waterproofing, structural work, engineering, roofing, masonry, tile work, hazardous-material remediation, permits, and work by other trades are excluded unless specifically listed.

The person approving the work represents that they are authorized to approve the scope and financially commit the Customer or responsible property owner.

Electronic or written approval, signature, payment, authorization to order material, authorization to schedule or begin work, or acceptance of delivery constitutes acceptance of the applicable Job Documents and these Terms.

Pricing based on photographs, customer descriptions, approximate measurements, plans, preliminary information, or other limited information is a pre-estimate and remains subject to field verification before custom ordering, fabrication, or final performance.

Oral conversations do not modify the agreement unless the change is subsequently documented and authorized.

3. FIELD VERIFICATION, CHANGES, AND ADDED WORK

Dimensions, glass or product makeup, thickness, safety treatment, hardware compatibility, fabrication, access, substrate, fastening conditions, framing, existing conditions, concealed conditions, and site readiness may require field verification.

KanView may make a necessary same-scope adjustment of up to 10% of an accepted estimate when reasonably required to complete the originally described work and will provide notice when practical.

Added work, a material change in scope, customer-requested changes, or an increase exceeding 10% requires documented authorization before proceeding, except immediate action reasonably necessary to protect people or property.

Authorization may be given by signature, electronic approval, email, text message, or another documented communication from the Customer or authorized representative.

Conditions discovered during removal, disassembly, drilling, demolition, or installation may require additional labor, products, fabrication, another trade, or discontinuation of the work.

KanView may stop or postpone work when actual conditions materially differ from what was represented or reasonably observable, or when continued work would be unsafe, impractical, structurally questionable, code-sensitive, or likely to cause unreasonable damage.

4. CUSTOMER-PROVIDED DIMENSIONS, DRAWINGS, AND INFORMATION

When KanView orders or fabricates material using dimensions, drawings, templates, plans, CAD files, specifications, model information, photographs, or other details supplied by the Customer or another party without independent KanView verification, the supplying party is responsible for the accuracy and completeness of that information.

Reordering, refabrication, replacement material, modifications, additional labor, or additional trips resulting from incorrect or incomplete customer- or third-party-supplied information are additional unless the error was caused by KanView.

Customer approval of final dimensions, patterns, glass configurations, hole locations, notch locations, hardware locations, drawings, or fabrication details authorizes production.

Tempered glass and other permanently fabricated products generally cannot be altered after fabrication.

5. MEASUREMENTS AND PROFESSIONAL EVALUATIONS

KanView may provide estimates from photographs, measurements, product information, and descriptions when the likely scope can reasonably be established.

A field measure may be required before ordering custom product.

When troubleshooting, diagnostic investigation, compatibility review, or another professional assessment is required before the scope can reasonably be determined, KanView may require a paid assessment. Any applicable assessment charge will be disclosed before the visit.

For distant work, KanView may first provide a pre-estimate. If onsite verification, measurement, or assessment is subsequently authorized, applicable travel or mobilization may apply.

6. SCHEDULING, CUSTOMER READINESS, AND ACCESS

Scheduling, delivery, and completion dates are estimates unless KanView expressly guarantees a date in writing.

Dates may change because of supplier availability, fabrication, freight, damaged incoming material, weather, emergency work, workload, equipment availability, site conditions, or circumstances outside KanView's reasonable control.

The Customer must provide safe and timely access, clear the work area, secure pets, protect or remove sensitive property, identify known concealed utilities and conditions, and provide an authorized onsite contact when requested.

The work area must be reasonably ready for KanView's scope. Examples of customer-caused readiness problems include inaccessible rooms, furniture or belongings preventing work, unfinished surfaces on which KanView must install, incomplete work by other trades, unavailable utilities reasonably required for the work, unavailable responsible personnel, unsafe animals, and restricted site access.

A cancellation or reschedule with less than 24 hours' notice, or KanView's arrival at a site that is not ready or accessible for the scheduled work, may be billed at $115 per scheduled technician, plus applicable nonrecoverable material, supplier, storage, travel, administrative, equipment, or remobilization cost.

For distant jobs, or when significant travel has already occurred or been committed, applicable travel and mileage may also be charged.

Customer-, occupant-, property-manager-, or site-caused waiting time after KanView is ready to perform may be billed at $115 per technician-hour, calculated in 15-minute increments after any applicable minimum.

7. CANCELLATION AFTER MATERIAL OR WORK COMMITMENT

Once KanView or its supplier has ordered product, begun cutting or fabrication, committed custom or nonreturnable material, reserved specialty equipment, incurred scheduling or mobilization cost, or otherwise made an unrecoverable commitment, the Customer remains responsible for the applicable committed costs.

Custom, fabricated, tempered, laminated, special-order, made-to-order, or otherwise nonreturnable material may not be canceled after production or another irreversible commitment begins.

Nothing in this section limits a statutory cancellation right that applicable law does not permit the Customer to waive.

8. DEFAULT PAYMENT TERMS

Unless the applicable Job Documents state otherwise, payment is due upon substantial completion of installed work, upon delivery of delivered material, or before release of pickup material, as applicable.

KanView may establish different deposit, prepayment, progress-payment, credit, or account terms for a particular Customer or project. Job-specific written payment terms control over the corresponding default.

No credit or extended-payment terms exist unless expressly approved by KanView. Prior Net terms, delayed invoicing, prior extensions, or KanView's decision not to immediately enforce payment on another job do not create continuing credit terms.

KanView may require a deposit or prepayment before scheduling, ordering, fabrication, delivery, or other material commitment.

Substantial completion occurs when the contracted materials and labor have been furnished and the listed scope is reasonably capable of its intended use, even if a minor punch-list item, adjustment, inspection, or warranty correction remains.

A warranty request or dispute concerning one part of a project does not suspend payment of undisputed amounts for completed work.

A good-faith disputed amount may be withheld only to the reasonable extent of the actual dispute. All undisputed amounts remain due.

9. LATE PAYMENTS AND COLLECTIONS

An undisputed balance not paid when due accrues a late charge of 1.5% per month, equivalent to 18% annually, or the maximum lawful rate, whichever is less, beginning after the due date.

KanView may suspend scheduling, future work, deliveries, account privileges, or other services while an account is delinquent.

To the extent permitted by law, the Customer is responsible for reasonable costs KanView incurs to collect an unpaid undisputed balance, including certified mailing expenses, filing fees, mechanic's-lien-related expenses, court costs, collection expenses, and reasonable attorney fees.

Partial payment, an extension, negotiation, continued work, or temporary forbearance does not waive KanView's right to collect the remaining balance or exercise lawful lien or collection rights.

10. CREDIT AND DEBIT CARD PAYMENTS

After advance disclosure, KanView may add a 3% surcharge to an eligible credit-card payment exceeding $5,000.

No surcharge will be imposed on a debit or prepaid card.

Any surcharge will not exceed KanView's cost, applicable law, or applicable card-network limits.

Other payment arrangements may be stated in the applicable Job Documents.

11. TRAVEL AND MOBILIZATION

KanView’s standard local service area is generally within 20 miles one way of KanView’s Topeka office unless the applicable Job Documents state otherwise.

Travel, mileage, delivery, mobilization, or additional trip charges may apply for work outside the local service area, repeated trips, special delivery, multiple vehicles, restricted access, rural or indirect routes, customer-requested return visits, remobilization, or other circumstances requiring additional travel.

Applicable travel or mobilization charges will normally be included in the quoted project price or stated in the applicable estimate, work order, service authorization, or other Job Document.

Additional travel or mobilization caused by a change in scope, customer-caused delay, unready site, additional requested work, or another circumstance not reasonably included in the original scope may be charged with appropriate notice or authorization.

A return visit required solely to correct a covered KanView workmanship defect is handled under the applicable warranty terms. Covered KanView workmanship warranty labor is provided at no charge. For warranty service outside KanView’s 20-mile local service area, applicable travel/mobilization charges apply.

12. JOBSITE CONDITIONS, SAFETY, AND OTHER TRADES

KanView may stop, postpone, or refuse work when conditions are unsafe or create unreasonable risk to people, glass, equipment, the structure, or surrounding property.

The Customer must disclose known hazards, fragile finishes, concealed utilities, alarms, restricted areas, environmental concerns, unusual cleaning requirements, pets, and other site conditions that could affect the work.

Hidden conditions may include rot, corrosion, pest damage, prior repairs, damaged framing or stops, unsuitable substrate, concealed wiring or plumbing, structural movement, water damage, mold, asbestos, lead, and code deficiencies.

Such conditions are outside the quoted scope unless specifically included.

KanView is responsible only for its own work. KanView is not responsible for another contractor's design, measurements, workmanship, schedule, framing, waterproofing, plumbing, roofing, flashing, masonry, tile work, electrical work, structural work, or other work.

Additional labor, material, waiting time, coordination, or remobilization caused by another party may be additional.

KanView may use qualified employees, subcontractors, suppliers, fabricators, installers, or specialty service providers to perform portions of the work.

13. EXISTING, AGED, BRITTLE, AND FRAGILE MATERIALS

Repair, reglazing, replacement, adjustment, or disassembly may require KanView to disturb existing materials.

Existing glass, frames, sash, stops, glazing beads, trim, vinyl, gaskets, clips, plastic plugs, fasteners, sealants, mirrors, J-channel, aluminum, hardware, tile, stone, wood, paint, stain, drywall, and surrounding finishes may have become brittle, adhered, corroded, weakened, deteriorated, distorted, or otherwise susceptible to damage through age, weather, ultraviolet exposure, moisture, prior installation, repairs, movement, paint, sealants, or hidden defects.

KanView will use reasonable care but cannot guarantee that existing materials can be removed, disturbed, reused, or reinstalled without cracking, chipping, splitting, bending, tearing, broken clips or plugs, finish loss, discoloration, sealant disturbance, or loss of reusability.

Damage resulting from pre-existing deterioration, inherent fragility, concealed weakness, previous installation methods, or reasonably necessary access is not a KanView workmanship defect.

Replacement product, additional fabrication, new stops, trim, gaskets, hardware, painting, staining, refinishing, surrounding-surface repair, and return labor are additional unless specifically included.

KanView remains responsible to the extent damage results from KanView's proven negligence or another obligation that applicable law does not permit KanView to disclaim.

14. LIMITED REPAIRS AND COMPONENT REPLACEMENT

Repair, adjustment, reglazing, glass replacement, sealant work, hardware replacement, and component-level service are limited to the specific items and conditions listed in the scope.

Work on one part of a system does not constitute inspection, restoration, certification, or warranty of the entire window, door, shower enclosure, storefront, frame, glazing system, building opening, or surrounding construction.

Other components may fail before or after KanView's work because of age, wear, prior installation, movement, product life, maintenance, environmental exposure, or unrelated conditions.

A later failure is not automatically attributable to KanView merely because KanView previously serviced another part of the system.

15. GLASS CHARACTERISTICS AND MANUFACTURING TOLERANCES

Glass may exhibit visual or optical characteristics caused by manufacturing, heat treatment, coatings, laminating, fabrication, thickness, size, installation, lighting, viewing angle, or reflected surroundings.

These characteristics can include optical distortion, roller wave, seeds, inclusions, minor surface imperfections within accepted tolerances, reflected-image distortion, coating appearance, pattern variation, edge variation, tempering distortion, haze, and color variation.

Characteristics within applicable manufacturer or industry tolerances are not workmanship defects.

Required safety-glass marks, tempering marks, certification marks, logos, etching, or labels may be visible.

Glass breakage alone does not establish defective workmanship. Glass may break from impact, thermal stress, edge damage, inclusions, building movement, later damage, temperature differences, improper use, or other causes.

Tempered glass generally cannot be cut, drilled, notched, or resized after tempering.

Laminated, coated, tinted, Low-E, patterned, heat-treated, and specialty products remain subject to applicable manufacturer characteristics, tolerances, limitations, and written warranties.

16. GLASS MATCHING, TINT, LOW-E, SPACERS, AND REPLACEMENT PRODUCTS

Replacement glass is manufactured at a different time from existing glass and may come from a different manufacturer or production line, or use a different currently available substrate, coating, tint, spacer, interlayer, pattern, or manufacturing technology.

Existing glass may change in appearance through age, ultraviolet exposure, weathering, deposits, cleaning history, seal condition, and surrounding interior or exterior finishes.

KanView therefore does not guarantee an exact match between replacement and existing or adjacent glass in color, tint, hue, reflectivity, visible-light appearance, Low-E appearance, clarity, thickness appearance, spacer appearance, pattern, texture, mirror tone, optical distortion, or reflected appearance unless an exact match is expressly guaranteed in writing.

Original products may become discontinued, obsolete, unavailable, or impossible to identify. KanView may provide or propose the specified or best reasonably available current replacement.

Replacement of one lite does not include replacement of surrounding or adjacent glass merely to obtain a closer visual match unless specifically listed.

Differences may become more visible under particular lighting conditions, exterior reflections, viewing angles, seasons, or times of day.

17. INSULATED GLASS UNITS

Replacement of an insulated glass unit applies only to the particular unit listed in the scope.

Replacement does not repair or warrant the surrounding sash, frame, drainage system, flashing, glazing stops, wall system, window construction, or other insulated glass units unless specifically included.

Failure of another existing unit before or after KanView's work is separate from the unit KanView replaced.

Spacer type or color, grid appearance, glass tint, coating, Low-E appearance, reflectivity, edge construction, or sealant appearance may differ from existing or adjacent units.

Interior-surface or exterior-surface condensation may be caused by temperature, humidity, ventilation, HVAC operation, weather, or building conditions and does not by itself establish insulated-glass seal failure or defective installation.

Qualifying insulated-glass product defects are subject to the manufacturer's applicable warranty and remedy.

18. WINDOWS, DOORS, FRAMES, AND BUILDING OPENINGS

Glass or window work does not repair underlying rot, corrosion, pest damage, warped framing, failed drainage, defective flashing, structural movement, settlement, damaged stops, poor prior installation, or surrounding building-envelope conditions unless specifically included.

Older or previously altered openings may be out of square, out of plumb, twisted, settled, damaged, or otherwise outside original manufacturing conditions. These conditions may affect fit, operation, sealing, and appearance.

Removal and installation may reasonably disturb surrounding caulk, paint, stain, trim, siding, drywall, sealants, or other finishes.

Painting, staining, refinishing, drywall repair, siding repair, trim restoration, and other finish work are excluded unless specifically listed.

Replacing glass, hardware, sealant, or another individual component does not create a warranty for the complete existing window or door assembly.

19. WATER INTRUSION, LEAK INVESTIGATION, AND SEALANTS

Water can travel through or within a building and may appear at a location far from its actual source.

Potential sources include glass, glazing, sealants, frames, drainage systems, flashing, roofs, siding, masonry, walls, curbs, waterproofing, plumbing, tile systems, settlement, movement, or surrounding construction.

Unless KanView expressly contracts to diagnose and correct the complete water-entry condition, work on one suspected source does not guarantee elimination of all water intrusion.

Payment remains due for work properly performed even when another unrelated, concealed, or additional source of water remains.

KanView's glass, sealant, window, storefront, or other work does not constitute a guarantee of the waterproof performance of the complete building envelope unless that responsibility is expressly included.

Sealants and caulks are affected by substrate condition, temperature, humidity, movement, ultraviolet exposure, weather, cleaning, and maintenance.

Shrinkage, discoloration, separation, movement, or deterioration resulting from these conditions is not automatically a workmanship defect. Periodic inspection, maintenance, and re-caulking may be required.

20. SHOWER ENCLOSURES AND WATER MANAGEMENT

Shower enclosures are water-management systems and are not designed to function as completely watertight containers.

Some water escape may occur depending on enclosure design, intentional operating gaps, seals, spray direction, shower-head placement, use of handheld sprayers, water pressure, body position, curb or threshold condition, wall condition, slope, movement, and normal use.

The shower enclosure itself is not the shower's waterproofing system.

Shower pans, membranes, drains, plumbing, tile, grout, stone, walls, curbs, thresholds, benches, ledges, and surrounding construction are the responsibility of others unless specifically included in KanView's scope.

Curbs, thresholds, benches, ledges, and other surfaces must be properly constructed and sloped to manage water appropriately.

Water escape or intrusion caused by an outward-sloped curb or ledge, incorrect shower construction, plumbing leaks, failed waterproofing, defective surrounding walls, building movement, or water traveling through or behind other construction is not a KanView enclosure workmanship defect.

Directing a handheld sprayer or shower stream toward intentional door gaps, hinge gaps, panel gaps, seals, or openings can result in water leaving the enclosure.

Frameless systems contain intentional operating clearances and generally depend more heavily upon spray direction, surrounding construction, slope, and optional sealing products for water management.

Optional seals, sweeps, caulking, or other water-management measures may reduce water escape but do not convert a shower enclosure into a guaranteed watertight system.

Adequate structural backing or suitable fastening substrate must be provided at required door-hinge and anchor locations unless KanView's scope specifically includes creating the required support.

Failure, movement, or door slipping caused by inadequate backing, unsuitable substrate, hollow construction, deterioration, or construction by others is not a KanView workmanship defect.

Drilling into tile, porcelain, stone, onyx, cultured material, or similar finishes carries inherent risk of cracking or damage, particularly when the material is already cracked, stressed, hollow, loose, improperly installed, or conceals unsuitable substrate. KanView will use reasonable care but cannot guarantee against failure caused by concealed weakness or pre-existing conditions.

KanView may require photographs, video, testing information, or reasonable troubleshooting before scheduling a shower water-related service or warranty visit.

If KanView determines that a reported water issue results from a covered KanView workmanship defect, the applicable warranty applies.

If an inspection determines the enclosure is properly installed and the reported condition results from customer use, spray direction, plumbing, waterproofing, slope, surrounding construction, movement, maintenance, or another condition outside KanView's work, the visit may be billed at the applicable service rate together with applicable travel or mobilization.

21. MIRRORS AND DECORATIVE GLASS

Existing mirrors, channels, clips, trim, backing, adhesives, and surrounding finishes may be fragile, deteriorated, or permanently bonded to the substrate.

KanView will use reasonable care but cannot guarantee damage-free removal or reuse of existing mirror or mirror-retention material.

Mirror tone, reflectivity, edge appearance, thickness appearance, silvering, tint, bevel, and color may differ between manufacturers and between new and aged mirror.

Adhesive-mounted mirror requires a suitable, stable, compatible, and reasonably dry substrate.

Failure caused by wall movement, substrate deterioration, moisture migration, contamination, incompatible coatings, concealed conditions, or another underlying problem is not a KanView workmanship defect.

If a particular mechanical retention or mounting method is recommended and the Customer directs another approved method, the limitations associated with the selected method apply.

Manufacturer adhesive cure times and handling instructions must be followed.

22. HARDWARE, FINISHES, ADJUSTMENTS, AND WEAR

Hardware, metal finishes, seals, sweeps, rollers, pivots, hinges, handles, closers, locks, latches, guides, and weathering components are subject to normal wear and maintenance.

Moisture, cleaning chemicals, abrasive products, corrosion, tarnishing, oxidation, environmental exposure, impact, excessive force, misuse, overloading, or customer alteration may affect appearance and operation.

Conditions caused by these factors are not workmanship defects unless they result from KanView's installation.

Exact finish matching to aged or existing hardware is not guaranteed unless expressly stated.

Replacing or adjusting one hardware component does not constitute a warranty of the entire existing assembly.

Building movement, settlement, temperature changes, use, wear, or surrounding components may require future routine adjustment.

Routine maintenance or adjustment is not automatically warranty work merely because KanView previously installed or serviced the product.

23. CUSTOMER-SUPPLIED PRODUCTS AND MATERIALS

When the Customer supplies glass, windows, doors, shower enclosures, mirrors, hardware, parts, or other products, the Customer is responsible for product selection, measurements, fit, compatibility, condition, completeness, intended use, and manufacturer warranty unless KanView expressly assumes responsibility for a specific item in writing.

KanView's warranty relating to customer-supplied product is limited to KanView's installation workmanship.

KanView does not warrant the customer-supplied product itself.

Missing parts, manufacturer defects, incorrect dimensions, compatibility problems, incomplete kits, unsuitable products, inaccurate instructions, customer selection errors, and product failures are not KanView workmanship defects.

KanView is not responsible for the success of field modification of customer-supplied material unless that modification is specifically included in KanView's scope.

Additional labor, product, fabrication, modifications, or trips caused by customer-supplied material are additional unless caused by KanView.

Existing and customer-owned glass or other fragile products may contain concealed weakness. KanView will use reasonable care but cannot guarantee such products against inherent or ordinary handling risk.

24. CLEANING, MAINTENANCE, AND CUSTOMER USE

The Customer is responsible for normal cleaning, lubrication, adjustment, sealant maintenance, hardware maintenance, and product care unless maintenance is specifically included.

Products should be cleaned and maintained according to applicable manufacturer instructions.

Abrasive pads, incompatible chemicals, harsh cleaners, prohibited solvents, pressure washing, improper tools, misuse, excessive force, neglected maintenance, or unauthorized modifications may cause damage and may exclude the resulting condition from workmanship warranty coverage.

Normal wear, condensation, environmental corrosion, humidity effects, building settlement, movement, and ordinary deterioration are not workmanship defects solely because they occur after KanView's work.

25. TEMPORARY BOARD-UP AND TEMPORARY PROTECTION

Board-up and other temporary protection are temporary measures only.

Unless specifically listed, temporary protection does not include permanent glazing, permanent framing, structural repair, weatherproofing, security certification, finish restoration, code upgrade, or permanent building-envelope repair.

Temporary material may deteriorate, move, weather, or require additional maintenance or replacement.

Permanent restoration is separate unless specifically listed.

26. SPECIALTY, STRUCTURAL, ENGINEERED, AND NONSTANDARD WORK

Engineering, structural design, load calculations, product certification, code certification, permit responsibility, life-safety certification, and performance certification are included only when specifically stated in writing.

Customer-directed or nonstandard use does not create a KanView representation that a product is suitable for a purpose beyond its manufacturer-approved or normally accepted application.

KanView may require manufacturer confirmation, engineering, technical review, additional equipment, or revised scope for structural glazing, glass railing, stairs, fire-rated glazing, security glazing, unusually heavy or oversized glass, questionable substrates, or nonstandard hardware applications.

KanView may refuse work when necessary technical, code, or safety information cannot reasonably be established.

27. WARRANTY

KanView workmanship warranty applies only to defects caused by KanView's performed work.

Unless the applicable Job Documents state a different approved warranty period, KanView's standard workmanship classifications are:

New installations: one year from substantial completion.
Repair installation work: 90 days from completion.
Standalone adjustments and service calls: 30 days from completion.

Manufacturer product defects are governed by the manufacturer's applicable written warranty and remedy.

KanView does not enlarge or modify a manufacturer's warranty unless KanView expressly agrees in writing.

A manufacturer agreeing to provide replacement product does not automatically include KanView's labor, removal, reinstallation, travel, freight, delivery, equipment, or other service unless the manufacturer or KanView expressly provides that coverage.

Warranty does not cover conditions caused by abuse, misuse, impact, vandalism, weather, building movement, ordinary wear, lack of maintenance, Customer or third-party alteration, pre-existing conditions, surrounding construction, customer-supplied material, manufacturer defects, or causes outside KanView's workmanship.

All undisputed amounts must be paid as required by the accepted agreement.

The Customer must promptly notify KanView of an alleged warranty condition and provide reasonable access.

KanView may request photographs, videos, product information, operating information, or reasonable preliminary troubleshooting before dispatching a technician.

When practical, KanView must be given a reasonable opportunity to inspect an alleged defect before the affected area is removed, destroyed, modified, or repaired by others.

Emergency action reasonably necessary to protect people or property is not prohibited, but the Customer should document the condition and notify KanView as soon as reasonably possible.

Alteration or repair by others that materially changes the condition or destroys evidence may limit KanView's ability to evaluate or remedy the claim.

A service or warranty inspection that finds no covered KanView workmanship defect may be billed at the applicable current service rate, plus applicable travel, mileage, access, or mobilization.

For a covered KanView workmanship defect, warranty labor is provided at no charge. For warranty service outside KanView's 20-mile local service area, applicable travel/mobilization charges apply.

Warranty work does not automatically restart or extend the original warranty period unless KanView expressly states otherwise.

28. DAMAGE, SHORTAGE, AND ISSUE REPORTING

Visible damage, shortage, or obvious installation concerns should be reported promptly and, when reasonably possible, within two business days after delivery or completion.

Other concerns should be reported promptly after discovery.

These notice provisions allow KanView to investigate while useful evidence remains available and do not waive rights that applicable law does not permit the Customer to waive.

Damage occurring after completion because of impact, customers, occupants, cleaners, movers, pets, contractors, other trades, weather, construction activity, misuse, or later site conditions is not KanView workmanship damage.

29. INSURANCE, FINANCING, AND THIRD-PARTY PAYMENT

The Customer remains responsible for the contract price regardless of insurance coverage, financing, landlord or tenant allocation, manufacturer reimbursement, warranty reimbursement, or payment expected from another party.

KanView may cooperate with an insurer, property manager, contractor, manufacturer, lender, or other third party but is not bound by that party's scope, allowance, administrative procedure, payment timing, or reimbursement decision unless KanView expressly agrees.

The Customer remains responsible for deductibles, uncovered amounts, funding shortfalls, financing reversals, and amounts not paid by a third party.

30. CUSTOMER ADMINISTRATIVE REQUIREMENTS

Customer purchase orders, portals, work-order systems, IVR systems, manager-signature procedures, photo requirements, check-in requirements, invoice formats, vendor forms, or similar administrative procedures do not modify KanView's scope, payment rights, warranty, liability, or these Terms unless an authorized KanView representative specifically agrees to the modification in writing.

KanView will make commercially reasonable efforts to follow disclosed administrative procedures.

System outages, inaccessible portals, unavailable managers, missing Customer personnel, technical failures, or similar conditions outside KanView's control do not make properly performed work nonpayable or automatically delay payment unless KanView expressly agreed that the procedure was a condition of payment.

31. OWNERSHIP, SECURITY, AND LIEN RIGHTS

Where lawful, title to uninstalled, stored, fabricated, or pickup material may remain with KanView until applicable payment obligations have been satisfied.

Once material has been incorporated into real property, KanView will not rely upon self-help removal unless separately agreed and lawful.

KanView retains all contract, collection, security, and mechanic's-lien rights available under applicable law.

Partial payment, additional time to pay, continued work, or temporary forbearance does not waive KanView's rights.

32. PICKUP, STORAGE, UNCLAIMED MATERIAL, AND CUSTOMER PROPERTY

KanView will make a reasonable attempt to notify the Customer when material or property is ready for pickup using the contact information available to KanView.

The Customer is responsible for keeping contact information current and retrieving material in a timely manner.

Material remaining unclaimed for more than 30 calendar days after the first ready-for-pickup notice may be subject to a $30 storage charge per month or portion of a month, after KanView has sent at least one additional reminder.

If material remains unclaimed for 90 calendar days after KanView's first ready-for-pickup notice, and KanView has made at least two reasonable attempts to notify the Customer, KanView may, to the extent permitted by applicable law, dispose of, recycle, discard, donate, return, sell, or otherwise handle the unclaimed material without further obligation to continue storing it.

Disposal, abandonment, recycling, return, sale, or other disposition of unclaimed material does not cancel, reduce, forgive, or otherwise satisfy amounts owed to KanView for the original product, custom fabrication, labor, delivery, handling, storage, special-order commitment, or other authorized charges.

All unpaid amounts remain due and remain subject to these Terms, except for any credit or disposition proceeds that applicable law requires KanView to apply.

Custom, tempered, fabricated, cut-to-size, special-order, or other customer-specific material remains the Customer's financial responsibility once the applicable nonreturnable commitment occurs even if the Customer never picks it up.

Customer-owned property left with KanView is subject to the notice and unclaimed-property provisions above only to the extent permitted by applicable law.

KanView will use reasonable care with customer-owned property but is not an insurer of it and is not responsible for inherent fragility, concealed weakness, deterioration, pre-existing damage, or ordinary storage and handling risk except to the extent caused by KanView's proven negligence or willful misconduct.

Customers accepting pickup or delivery material are responsible for proper transportation, handling, protection, and storage after release.

33. REMEDIES AND LIMITATION OF LIABILITY

For a covered workmanship claim, KanView may repair the affected work, replace the affected KanView-supplied item, or refund the amount paid for the affected scope, at KanView's reasonable election when permitted by law.

To the maximum extent permitted by law, KanView is not liable for indirect, incidental, special, exemplary, or consequential damages, including lost use, lost profit, business interruption, or losses resulting solely from delay.

To the maximum extent permitted by law, KanView's total liability arising from a claim will not exceed the amount paid for the affected scope.

Nothing in these Terms excludes or limits KanView's responsibility for proven negligence, willful misconduct, or another obligation that applicable law does not permit KanView to disclaim or limit.

34. FORCE MAJEURE AND EVENTS OUTSIDE KANVIEW'S CONTROL

KanView is not responsible for reasonable delay or inability to perform caused by circumstances outside KanView's reasonable control.

These may include severe weather, natural disaster, fire, utility interruption, transportation disruption, supplier or manufacturer delay, material shortage, labor shortage, government action, civil emergency, widespread equipment failure, carrier problems, or similar events.

KanView will make commercially reasonable efforts to resume performance when conditions permit.

35. SALES TAX

Unless a Job Document expressly states otherwise, KanView presents one total project price and does not separately state applicable sales tax.

All applicable sales taxes are included in the quoted package price unless expressly stated otherwise.

Tax treatment depends upon the work classification, job or delivery location, exemption status, and applicable law.

A change in project address, delivery location, exemption documentation, project classification, or taxable scope may require adjustment before work or ordering is finally authorized.

36. CONTRACT PRIORITY AND CUSTOMER-PROVIDED TERMS

The accepted KanView Job Documents, these Terms, approved change orders, and any separately signed KanView addendum form the agreement relating to the work.

Customer purchase-order terms, work-order boilerplate, portal terms, vendor-system terms, administrative forms, or other customer-generated language do not modify the agreement unless an authorized KanView representative specifically accepts the particular modification in writing.

Administrative acceptance of a Customer purchase order, portal, work order, vendor system, or similar document does not constitute acceptance of conflicting contractual terms.

37. GOVERNING LAW, VENUE, AND DISPUTES

Kansas law governs this agreement.

Unless applicable law requires another venue, any court proceeding arising from the agreement will be brought in Shawnee County, Kansas.

KanView retains the right to pursue all lawful collection, lien, contractual, and court remedies.

If any provision of these Terms is found invalid or unenforceable, it will be limited or severed only to the minimum extent necessary, and the remaining provisions will continue in effect.

Failure by KanView to enforce a provision on one occasion does not waive the right to enforce that provision later.

38. STATUTORY AND NONWAIVABLE RIGHTS

Nothing in these Terms waives or shortens a statutory cancellation right, consumer-protection right, warranty right, or other obligation that applicable law does not permit the Customer to waive.

When a transaction qualifies for a legally required cancellation notice or cancellation period, KanView will provide or honor the applicable required procedure.

39. ENTIRE AGREEMENT

The accepted Job Documents, these Terms, approved change orders, and any separately signed KanView addendum constitute the agreement between KanView and the Customer regarding the listed work.

Prior discussions, advertisements, representations, emails, texts, or oral statements do not modify the final agreement unless incorporated into an accepted Job Document or subsequent authorized written change.

40. CUSTOMER ACCEPTANCE

By electronically or physically signing or approving an estimate or work order, making a payment, authorizing KanView to order material, authorizing scheduling or work to begin, accepting delivery, or otherwise directing KanView to perform the listed work, the Customer confirms that the Customer has reviewed the listed scope and applicable job-specific terms, has had an opportunity to ask questions, represents that they are authorized to approve the work, and accepts the applicable Job Documents and these Full Terms & Conditions, subject to rights that applicable law does not permit the Customer to waive.
